1. About this policy

This Privacy Policy is issued by THDR Australia Pty Ltd (trading as THEODORE) ("THEODORE", "we", "our" or "us"). It describes how we collect, hold, use and disclose personal information in connection with our websites, our online store, the THDR Pocket Tailor application, our studios, showrooms, touring events and pop-ups, our social media channels, and our products and services generally (together, the "Services").

We are committed to handling personal information in accordance with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth), and, where they apply to you, other privacy laws of the jurisdictions in which we operate.

By using the Services, or by providing personal information to us, you acknowledge this Privacy Policy and, to the extent your consent is required, you consent to our collection, holding, use and disclosure of your personal information as described in it. If you do not agree, please do not use the Services.

2. Information we collect

We collect information that is reasonably necessary for, or directly related to, our business activities. Depending on how you interact with us, this may include, without limitation:

  • Identity and contact information, such as your name, email address, phone number, billing and delivery addresses, and date of birth.
  • Order and transaction information, such as products viewed or purchased, garment customisations, order value and history, returns and remakes, and payment method details (full payment card numbers are processed by our payment providers and are not stored by us).
  • Fit and measurement information, such as body measurements, sizing preferences, fit feedback, and measurement codes, whether provided by you, taken at an appointment, or generated through the THDR Pocket Tailor application. The Pocket Tailor processes device camera captures to derive a measurement profile; the derived measurements and related capture data are collected by us when you submit or link them to an order or account.
  • Appointment and event information, such as bookings, attendance, stylist notes and preferences.
  • Communications, such as emails, calls, chats, reviews, survey responses and social media interactions, including records of our correspondence with you.
  • Technical and usage information, such as IP address, device identifiers, browser type, operating system, pages viewed, referring URLs, session activity, and interactions with our emails and advertising, collected through cookies and similar technologies.
  • Information from third parties, such as from our service providers, payment and buy-now-pay-later providers, delivery partners, advertising and analytics partners, social media platforms, and publicly available sources.

If you provide us with personal information about another person (for example, when purchasing a gift or booking a group appointment), you represent that you are authorised to do so and that they have been made aware of this Privacy Policy.

3. How we use your information

We may use personal information for any purpose reasonably related to the operation, improvement, marketing and growth of our business, or otherwise with your consent or as permitted by law, including without limitation to:

  • provide the Services, including making and fulfilling made-to-order garments to your measurements, processing payments, arranging delivery, and administering returns, remakes and our Perfect Fit Guarantee;
  • create and administer your account, appointments and measurement profiles;
  • operate, maintain, protect, evaluate and improve the Services, our garments, our patterns and our processes;
  • develop, train, test and improve our technology, including the measurement algorithms, machine-learning models and related systems that power the THDR Pocket Tailor;
  • personalise your experience, including recommendations, saved preferences and tailored content and offers;
  • communicate with you, including service messages, appointment reminders and customer support;
  • send you direct marketing (including by email, SMS, phone, post and through online platforms) about our products, services, events, offers and partnerships, until you opt out;
  • conduct advertising and marketing, including audience building, campaign measurement, and interest-based advertising on third-party platforms;
  • carry out analytics, research, planning and product development;
  • detect, investigate and prevent fraud, security incidents and misuse of the Services;
  • comply with our legal and regulatory obligations, and establish, exercise or defend legal claims; and
  • support any actual or proposed corporate transaction involving our business.

De-identified and aggregated information. We may de-identify or aggregate information (including measurement and usage information) so that it no longer identifies any individual. De-identified and aggregated information is not personal information, and we may create, use, disclose, license and commercialise it for any purpose without restriction.

4. Cookies and similar technologies

We and our partners use cookies, pixels, SDKs and similar technologies to operate the Services, remember your preferences, measure performance, and deliver and measure advertising. Our online store runs on Shopify, whose systems also set cookies necessary to operate the store and checkout.

You can manage cookies through your browser settings. Some features of the Services may not function properly without them. We currently do not respond to "Do Not Track" browser signals.

5. How we disclose your information

We may disclose personal information, for the purposes described in this policy, to:

  • our related companies within the THDR group;
  • service providers that support our business, including e-commerce and hosting (such as Shopify), cloud and data processing (such as Amazon Web Services and Microsoft Azure), payment and buy-now-pay-later providers, fraud screening, tailoring and production partners, delivery and logistics providers, appointment scheduling (such as Calendly), communications, marketing and customer-support platforms, and professional advisers;
  • advertising, analytics and social media partners, who may use information collected through cookies and similar technologies (such as identifiers, device information and site activity) to build audiences and show you relevant advertising on other platforms. In some jurisdictions (such as California), this kind of disclosure may be treated as a "sale" or "sharing" of personal information for targeted advertising, you may opt out as described in section 8;
  • production and fulfilment partners, including the provision of measurements and customisations to our workrooms and quality-control partners to make your garments;
  • a purchaser or prospective purchaser (and their advisers) of all or part of our business or assets, including in connection with any merger, acquisition, financing, restructure or insolvency event, in which case personal information may be transferred as a business asset; and
  • government authorities, regulators, courts and other parties where we consider disclosure is required or authorised by law, or reasonably necessary to protect our rights, property, safety or customers.

We do not disclose your identifiable personal information to unrelated third parties for their own independent marketing use in exchange for payment. If that ever changes, we will update this policy and provide any notice and choices required by law before doing so.

6. Overseas disclosure

We operate from Australia, and our service providers, production partners and systems are located in Australia and overseas, including in New Zealand, the United States, the United Kingdom, Europe and Asia. By using the Services you acknowledge that your personal information may be transferred to, stored in and processed in countries other than your own, which may have different privacy protections. Where the Privacy Act or other applicable law requires, we take reasonable steps to ensure overseas recipients handle personal information consistently with this policy.

7. Retention and security

We retain personal information for as long as we consider it necessary for the purposes described in this policy, including maintaining your measurement profile for future orders, remakes and our Perfect Fit Guarantee, or as required or permitted by law, after which we take reasonable steps to destroy or de-identify it.

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

8. Your choices and rights

Marketing. You may opt out of direct marketing at any time using the unsubscribe link in our emails, replying STOP to SMS, or contacting us using the details below. We may still send you non-promotional service messages.

Access and correction. You may request access to, or correction of, the personal information we hold about you. We will respond within a reasonable period and in the manner required by the Privacy Act. We may decline requests where the law permits, and we will tell you why.

Deletion. You may request deletion of your personal information by email to hello@thdr.co, by phone on +61 1300 395 829, or by post to 88 Pitt Street, Redfern NSW 2016, Australia. We will action requests to the extent required by applicable law, subject to information we need to retain (for example, transaction records).

Targeted advertising. Where applicable law gives you the right to opt out of "sales", "sharing" or targeted advertising, you may exercise it by contacting us at hello@thdr.co with the subject line "Personal Information Opt-Out", or through the cookie controls described in section 4.

Additional regional rights. If the law of your location (for example, the EU/UK GDPR or a US state privacy law) gives you additional rights, such as portability, restriction or objection, we will honour those rights to the extent that law applies to us and to you. We may need to verify your identity before actioning any request.

9. Other matters

Children. The Services are not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us and we will take reasonable steps to delete it.

Third-party sites. The Services contain links to third-party websites and services (including payment, buy-now-pay-later and social platforms). We are not responsible for their privacy practices, and this policy does not cover them.

Changes to this policy. We may update this Privacy Policy from time to time in our discretion. The current version will always be posted on our website, and changes take effect when posted. Your continued use of the Services after a change constitutes acceptance of the updated policy. Material changes may also be notified by email or on-site notice where required by law.

We take complaints seriously and will investigate and respond within a reasonable period (usually within 30 days). If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au, or the privacy regulator in your jurisdiction.
